Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Vital2Doc iOS application and related services operated by Vital2Doc ("we," "us," or "our"). By downloading or using Vital2Doc, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading the application, or accessing any features of Vital2Doc, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use Vital2Doc. These Terms constitute a legally binding agreement between you and Vital2Doc.

2. Eligibility

To use Vital2Doc, you must:

  • Be a licensed, practising physician, doctor, or qualified medical professional; or be employed as clinic staff at an enrolled healthcare facility
  • Be at least 18 years of age
  • Have the legal authority to enter into a binding agreement
  • Not be barred from using medical software under applicable laws or regulations

Vital2Doc is strictly a professional tool for healthcare providers. It is not intended for use by patients, the general public, or individuals without a verified healthcare role.

3. Account Registration

When you register for a Vital2Doc account, you agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your password and not share login credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorised use at support@vital2doc.com

We reserve the right to refuse account registration or suspend accounts that provide false information or violate these Terms.

4. Permitted Use

You May
  • View and manage assigned patient vital sign data
  • Communicate securely with assigned patients via encrypted chat
  • Review documents shared by patients you are assigned to
  • Collaborate with clinic colleagues within your assigned facility
  • Use the platform for legitimate patient care purposes
You May Not
  • Access patient data without a valid consent assignment
  • Share your credentials or allow others to use your account
  • Use the platform for patients outside your assigned roster
  • Export or store patient data outside the platform without authorisation
  • Attempt to reverse-engineer or bypass security controls

5. Medical Disclaimer

Vital2Doc is a communication and data-viewing platform. It is a tool to support your clinical practice not to replace it.

Vital2Doc does not provide medical advice, diagnosis, or treatment. All clinical decisions remain the sole responsibility of the licensed healthcare provider. Vital signs and data displayed are for informational purposes only.

  • Patient vital data may be subject to device measurement errors or transmission delays
  • Always apply independent clinical judgement do not rely solely on app data
  • In emergencies, follow your standard protocols and contact emergency services
  • Vital2Doc is not a substitute for in-person examination or certified medical devices

6. Patient Data & Consent

Access to patient data through Vital2Doc is governed by a consent framework:

  • You may only access a patient's data after they have accepted a consent request in the DrPulse application
  • Patients can revoke consent at any time, immediately removing your access to their data
  • You are solely responsible for using patient data in compliance with applicable healthcare privacy laws (HIPAA, GDPR where applicable)
  • You must not retain, copy, or share identifiable patient data outside the platform without the patient's explicit consent and applicable legal authority
  • You agree to promptly report any suspected data breach to privacy@vital2doc.com

As a user handling Protected Health Information (PHI), you take on the obligations of a HIPAA Covered Entity or Business Associate. Clinics may request a BAA from us at privacy@vital2doc.com.

7. Intellectual Property

All intellectual property rights in the Vital2Doc platform including the iOS application, design, code, trademarks, and content are owned by or licensed to Vital2Doc.

  • We grant you a limited, non-exclusive, non-transferable licence to use the app for its intended purpose
  • You may not copy, modify, distribute, sell, or reverse-engineer any part of the platform
  • The "Vital2Doc" name and logo are trademarks of Vital2Doc and may not be used without written permission
  • Data you enter into the platform (your notes, clinical observations) remains yours; you grant us a licence to process it to provide the service

8. Prohibited Conduct

In addition to restrictions in Section 4, you expressly agree not to:

  • Attempt to gain unauthorised access to any part of the service, server, or network
  • Introduce malware, viruses, or any harmful code into the platform
  • Use automated scripts, bots, or scrapers to access or collect data
  • Harass, threaten, or harm other users through the platform's messaging features
  • Misrepresent your identity, credentials, or affiliation
  • Use the platform to facilitate fraud, illegal activity, or violations of patient rights
  • Attempt to circumvent encryption or access data belonging to patients not assigned to you

Violations may result in immediate account suspension and reporting to relevant regulatory or law enforcement authorities.

9. Service Availability

We strive to maintain high availability, but we do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance with reasonable advance notice where possible
  • Temporarily suspend access for security incidents, technical issues, or updates
  • Modify, discontinue, or add features at our discretion with notice

Do not use Vital2Doc as your sole system for critical patient monitoring. Always maintain backup processes for urgent patient communication and data access.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Vital2Doc is provided "as is" without warranties of any kind, express or implied
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not liable for clinical decisions made using data viewed on the platform
  • Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if no payment was made)
  • Some jurisdictions do not allow limitation of implied warranties in such cases, these limitations apply to the fullest extent permitted by law

11. Account Deletion

In accordance with Apple App Store guidelines and applicable data protection laws, you have the right to request deletion of your Vital2Doc account at any time.

How to Request Deletion — In-App (Recommended)

The simplest way is directly from the app:

  • Open Vital2Doc on your iPad and go to Profile & Settings
  • Scroll to the bottom and tap "Request Account Deletion"
  • Confirm through the two-step dialog
  • Your account is deactivated immediately and you are signed out
  • All active sessions are terminated instantly (JWT tokens revoked)

How to Request Deletion — By Email

You can also email us at support@vital2doc.com from your registered email address requesting account deletion. Include your full name, registered email, and license number for verification.

What "deletion" means in practice: When you submit a deletion request, your account is immediately deactivated — you cannot log in and no data is accessible. The Vital2Doc team reviews the request and permanently removes your account data within 30 days, subject to any legal retention obligations (see our Data Retention Policy).

Some data — such as audit logs and records required by HIPAA — must be retained for regulatory compliance and cannot be immediately purged even after a deletion request. See Privacy Policy §6 for retention periods.

Once your account deletion is confirmed, you will receive a notification email at your registered address. If you have questions about a pending deletion, contact support@vital2doc.com.

12. Termination by Us

We reserve the right to suspend or terminate your access immediately if you:

  • Violate any provision of these Terms
  • Engage in conduct harmful to patients, other users, or the platform
  • Fail to maintain valid professional credentials or clinic membership
  • Are subject to professional sanctions that affect your eligibility to use medical software

Upon termination, your right to access the platform ceases immediately. Patient data you accessed is governed by our data retention policy and applicable law.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of Vital2Doc shall be resolved through good-faith negotiation, followed by binding arbitration if negotiation fails, except where prohibited by local law.

Nothing in these Terms limits your rights under applicable consumer protection, healthcare, or data privacy legislation in your jurisdiction.
